SP&F Helps Protect Park Districtís Right to Control Its Property

When an advocacy group for hunters, trappers and anglers wanted full access to the 1730 acres owned by the Winooski Valley Park District and the land it leases, to hunt and trap, WVPD turned to Stitzel, Page & Fletcher, P.C.
SP&F obtained summary judgment for WVPD in Chittenden Superior Court. On November 17, the Vermont Supreme Court issued an opinion affirming the lower Courtís grant of summary judgment. Hunters, Anglers & Trappers Assoc. of Vermont, Inc. v. Winooski Valley Park District, 2006 VT 82 (Nov. 17, 2006). Justice Johnson, writing for the majority, opined that municipalities in Vermont have the requisite legal authority to post their own property and to preclude hunting and trapping without violating the Vermont Constitution or Dillonís Rule.
