Candidates Must File Consents Within Statutory Timelines

A candidate for state office in Vermont who fails to timely file the ìconsent of candidateî form required by 17 V.S.A. ß2361 by the statutory deadline cannot appear on the election ballot. An incumbent member of the Vermont House of Representatives failed to make a timely filing to be on the ballot. A lawsuit requesting extraordinary relief from the superior court was unsuccessful. On appeal, the Vermont Supreme Court found no error. Reading the statute literally, the filing requirement and associated deadline are mandatory prerequisites to being on the ballot.
