School Not Liable for Expertís Fees under IDEIA

The US Supreme Court ruled recently that a school district was not obligated by the IDEIA to reimburse prevailing parents for costs of experts. Parents of a special education student sought to recover $29,250 in fees charged by their educational consultant. The Supreme Court opined that the IDEIA does not explicitly provide for reimbursement or recovery of these fees, unlike attorneys fees, and therefore the district cannot be liable for them. Arlington Central School Dist. v. Murphy, No. 05-18 (June 26, 2006).
